Unite Eurotherapy, Inc., a California-based manufacturer of hair care products, has filed a lawsuit against three logistics companies after a shipment worth over $1 million was hijacked. The complaint was lodged on December 8, 2025, in the United States District Court for the Southern District of Ohio against Broussard Logistics, LLC, Freight Cowboy, LLC, and Old City Express, LLC.

The case revolves around an ill-fated shipment that was supposed to be a routine delivery from Unite’s facility in California to a customer in Ohio. Unite hired Broussard Logistics and Freight Cowboy to manage the transportation. However, these companies subcontracted Old City Express without conducting due diligence. Unbeknownst to them, fraudsters impersonating Old City managed to intercept the shipment. The real Old City had suffered a data breach but failed to notify any parties involved. As per the complaint, “Broussard and Freight Cowboy hired a fraudster(s) impersonating Old City,” leading to the theft of goods valued at over $1 million.

Unite alleges that both Broussard and Freight Cowboy ignored several red flags during this transaction. For instance, they failed to verify contact details through official channels or confirm the authenticity of email communications. Furthermore, Old City’s systems were compromised as early as June 6, 2025—the same day the fraudulent pickup occurred—yet no alerts were issued. According to Unite’s filing, “Old City did not take appropriate actions to secure its email and data from being accessed by bad actors.”

The plaintiff accuses Broussard and Freight Cowboy of breaching their contractual obligations by failing to provide adequate logistical services and exercise reasonable care in selecting carriers. They also accuse Old City of negligence for not safeguarding its information systems or notifying affected parties about the security breach. Unite is seeking compensatory damages significantly exceeding $75,000 along with pre- and post-judgment interest and attorney fees.

Representing Unite Eurotherapy are attorneys Thomas J. Whaling, Kimberly Weber Herlihy, and Michael T. Fahy from Vorys, Sater, Seymour and Pease LLP based in Columbus, Ohio. The case is identified as Case No: 2:25-cv-01437-JLG-EPD before Judge James L Graham.
