In a recent court filing, Samantha Toney has initiated a class action lawsuit against Evenflo Company, Inc. in the United States District Court for the Southern District of Ohio. The case centers around allegations that Evenflo’s Revolve Slim 360 car seats are dangerously unsafe for infants due to a choking hazard associated with the car seat headrest. Despite being aware of the defect since October 2023, Evenflo allegedly continued to sell these products until a recall was issued on September 29, 2025. Toney, representing herself and others who purchased the defective car seats, claims that consumers were not informed about these risks at the time of purchase and are seeking damages exceeding $5 million.

The lawsuit argues that Evenflo failed to provide adequate warnings or remedies and did not offer full refunds or suitable replacements following the recall. Instead, they proposed a repair kit solution which plaintiffs argue is insufficient. The plaintiff seeks compensation for losses incurred due to purchasing what they describe as worthless and dangerous products.
