In a recent court filing, Prince Rankin has initiated legal action against Dave Yost, the Attorney General of Ohio, challenging the constitutionality of Ohio’s medical-claim statute of repose under R.C. § 2305.113(C). Rankin argues that the statute unjustly bars claims from individuals who discover their injuries after the statutory period or those who have refiled within the one-year saving period as per Ohio’s saving statute (R.C. § 2305.19(A)). The case is filed in the United States District Court for the Southern District of Ohio and seeks declaratory and injunctive relief to prevent future enforcement of these provisions. Rankin contends that the statute violates due process and equal protection clauses by denying him a meaningful opportunity to litigate his medical malpractice claim related to treatment received in 2016.
