In a recent legal development, a high-profile case involving allegations of medical malpractice has reached the Ohio First District Court of Appeals. The plaintiffs, Kaitlyn Boggs, Amanda Koch, and Eddie Stallings, have brought forth claims against Dr. Abubakar Atiq Durrani and the Center for Advanced Spine Technologies, Inc., alleging unnecessary surgeries that resulted in significant harm. This complaint was filed on January 23, 2026, in Hamilton County, Ohio.
The case revolves around accusations that Dr. Durrani performed unwarranted spinal surgeries on the plaintiffs without proper informed consent. The plaintiffs claim that these procedures were not only unnecessary but also caused them permanent damage. They allege that Dr. Durrani misled them about their medical conditions and exaggerated the severity of their spinal issues to justify surgical interventions. “He told me he could fix my symptoms,” testified Kaitlyn Boggs during the trial, expressing her reliance on Dr. Durrani’s assurances.
The jury found in favor of the plaintiffs on several counts including battery, negligence, fraud, and lack of informed consent. The court consolidated these cases due to common questions of law and fact among them—each plaintiff underwent similar procedures along the spine under Dr. Durrani’s care. Despite objections from the defense regarding consolidation potentially leading to prejudicial evidence being admitted, the court proceeded with a joint trial.
Plaintiffs are seeking substantial compensation for past and future medical expenses as well as noneconomic damages for pain and suffering. They argue that they have endured ongoing pain since their surgeries and face future medical costs due to corrective procedures necessitated by Dr. Durrani’s actions.
The court awarded compensatory damages totaling over $1 million each to Boggs and Koch, with Stallings receiving nearly $700,000. Additionally, punitive damages amounting to $9 million plus attorney’s fees were granted to each plaintiff as a result of the jury’s findings.
