Plaintiff Alleges Municipal Court Judge Violated First Amendment Rights

In a bold legal move, an individual has taken to the courts to challenge what he claims is a violation of his First Amendment rights. Vincent Lucas filed a complaint in the United States District Court for the Southern District of Ohio on February 26, 2026, against Judge Zachary O. Zoz of the Fairfield Municipal Court. Lucas alleges that Judge Zoz’s actions have unlawfully restricted his freedom of speech and press.

The case centers around events from June 5, 2024, when Judge Zoz, then acting as a magistrate for the Fairfield Municipal Court, presided over a pretrial hearing in City of Fairfield v. Haussler. During this hearing, Lucas claims that Judge Zoz accepted an unlawfully coerced guilty plea from Haussler due to threats made by prosecutor Kyle Rapier regarding Lucas’s constitutionally protected speech. According to Lucas, these threats were based on content shared on “My Facebook Site,” which was not under Haussler’s control but rather was operated by Lucas himself.

Lucas asserts that following the hearing, Judge Zoz issued orders that effectively shut down his Facebook site and imposed a no-contact order against Haussler that indirectly targeted him. This order purportedly threatened Haussler with contempt and potential jail time should Lucas continue to exercise his free speech rights through his online platforms. Consequently, Lucas argues that these judicial actions have had a chilling effect on his ability to express himself freely online.

In his complaint, Lucas accuses Judge Zoz of viewpoint-based censorship and content-based restrictions in violation of the First Amendment. He argues that the shutdown order was motivated by criticism directed at the criminal case against Haussler and praises for her efforts related to an “Abused Child.” Furthermore, he contends that Judge Zoz failed to establish any criteria for what third-party speech would result in holding Haussler responsible, thereby leaving only critical or unfavorable speech subject to punishment.

Lucas is seeking declaratory judgments from the court affirming violations of his First Amendment and Due Process rights and declaring all content-based restrictions null and void. Additionally, he requests permanent injunctions preventing further infringement upon his rights or retaliatory actions against him or Haussler related to this case or any other litigation involving him. He also seeks compensation for attorneys’ fees and litigation costs incurred during this legal battle.

Representing himself pro se in this matter is Vincent Lucas. The case has been assigned Case ID: 1:26-cv-00207-MWM-SKB before Judge Matthew W. McFarland and Magistrate Stephanie K. Bowman.
