A case of alleged medical negligence has been brought to light, where a plaintiff claims that an error by a laboratory led to months of unnecessary treatment and isolation. On October 16, 2025, LaDarla Kingrey filed a complaint in the Court of Common Pleas in Franklin County, Ohio against Labcorp and Laboratory Corporation of America Holdings d/b/a Labcorp.
The complaint narrates a distressing sequence of events beginning on December 26, 2022, when Kingrey underwent a cardiac evaluation at Reid Hospital in Indiana. The evaluation revealed a pulmonary mass on her left lower lobe. Following this discovery, on February 13, 2023, her family care physician referred her for further consultation to Dr. Patrick Allan at Dayton Respiratory Center. A bronchoscopy was performed on February 20, 2023, and samples were sent to both Kettering’s Department of Pathology and Labcorp’s Dublin facility for analysis.
On April 11, 2023, Labcorp reported that Kingrey’s samples tested positive for acid-fast bacilli (AFB), the bacteria responsible for tuberculosis (TB). Consequently, she was informed by Dr. Allan on April 27 that she must undergo isolation and begin an intense medication regimen known as “RIPE” while being monitored by the Preble County Health Department through Direct Observed Therapy (DOT).
Despite undergoing another bronchoalveolar lavage (BAL) on June 21, the results from Labcorp only came back negative for TB on August 8. However, it wasn’t until October 23 that Labcorp disclosed their initial diagnosis was erroneous due to a lab error. Yet even then, Kingrey remained uninformed until November 28 when her infectious disease specialist finally revealed the mistake.
Kingrey accuses Labcorp of negligence for failing to provide accurate test results which led to false confinement and unnecessary medical treatment causing physical ailments like weight loss and rashes as well as psychological distress including PTSD and depression. She seeks economic and non-economic damages exceeding $25,000 along with attorneys’ fees.
Representing Kingrey are attorneys Sanford A. Meizlish and Brian W. DelVecchio from Barkan Meizlish DeRose Cox LLP. The case is filed under Case No., with Judge presiding over it.
