A former employee is taking legal action against a major healthcare organization, alleging age and gender discrimination. Jennifer Nyitray filed a complaint in the United States District Court for the Southern District of Ohio on January 30, 2026, accusing Bon Secours Mercy Health Inc. of discriminatory practices that led to her wrongful termination.
Jennifer Nyitray, who worked as a Physician’s Assistant (PA) at Bon Secours Mercy Health Inc., claims she faced disparate treatment due to her age and gender during her tenure with the company. According to the lawsuit, Nyitray was hired by Mercy in February 2011 and had been recognized for her exemplary performance, even receiving an award for Provider of the Month. Despite her qualifications and achievements, Nyitray alleges that younger and male colleagues were given preferential treatment in terms of shift modifications, workload distribution, and access to resources. She contends that supervisors Sarah Schulte and Ashley Guisinger favored younger employees like Elaina Wiedman over her. Additionally, Dr. XX Chanamolu allegedly provided more opportunities to male employees such as Eric Niemeyer while denying similar privileges to Nyitray.
Nyitray’s complaints about this alleged discrimination went unaddressed by the company despite reporting them twice to Human Resources in October 2024. Her first report detailed unfair treatment based on age and gender but was reportedly ignored by Mercy without any investigation or response. A second report followed shortly after, yet it too was met with silence from HR representatives like Jane Lammers. The lack of action from Mercy violated their own Anti-Discrimination Policy according to Nyitray’s claims.
The situation escalated when Nyitray raised concerns about being required to manage high-risk pulmonary patients without adequate supervision—a practice she deemed unsafe for patient care. Following these complaints, on November 4, 2024, Nyitray was terminated from her position at Mercy under what she believes were pretextual reasons masking underlying discriminatory motives related to her age and gender.
In her lawsuit, Nyitray accuses Bon Secours Mercy Health Inc. of violating federal laws including Title VII of the Civil Rights Act of 1964 and the Age Discrimination in Employment Act (ADEA), as well as Ohio state laws against discrimination under R.C. § 4112.02 et seq. She seeks compensatory damages exceeding $25,000 per claim for lost wages and emotional distress along with punitive damages for what she describes as malicious conduct by Mercy.
