In a legal battle that underscores the complexities of public records law, a man has been denied his request for unredacted legal invoices from a township board. On November 12, 2025, Brian M. Ames filed a complaint in the Court of Appeals for the Ninth Judicial District in Summit County against the Northfield Center Township Board of Trustees and Baker Dublikar Law Firm. The case centers around alleged violations of Ohio’s Open Meetings Act and Public Records Act.
The dispute began when Ames requested copies of legal service invoices related to his civil action against the Northfield Center Township Board. The invoices were heavily redacted, prompting Ames to file a mandamus action seeking unredacted versions. Despite receiving an explanation for the redactions citing pending litigation and Ohio Supreme Court precedent, Ames pursued statutory damages, costs, and attorney fees. He argued that the redactions amounted to a denial of his public records request and lacked immediate explanation.
The court found that Ames’ mandamus claim was moot as he eventually received the requested records. However, it addressed his claims for statutory damages and other reliefs separately. According to Ohio law, statutory damages are only awarded if there is non-compliance with public records obligations. The court concluded that the initial invoice redactions were lawful due to ongoing litigation between Ames and the Board. It also determined that an explanation for these redactions was provided promptly via email.
Ames contended that statutory obligations were unmet because explanations weren’t included with initial responses or sent by authorized individuals directly handling public records requests. However, former R.C. 149.43(B)(3) did not specify such requirements; thus, the court ruled against Ames’ interpretation.
Despite acknowledging Ames’ pro se status which disqualified him from attorney fees, he sought court costs under specific provisions of R.C. 149.43(C)(3)(a). Yet again, since no writ of mandamus was granted nor bad faith proven on part of respondents during document provision post-filing but pre-judgment order issuance—his requests were denied across all fronts.
