Ohio-base medical supplier is suing a healthcare provider for trademark infringement

In a legal battle over trademark rights, an Ohio-based company is taking action to protect its brand identity. On January 5, 2026, TEMEG Holdings, Inc., doing business as GEMCORE, filed a complaint in the United States District Court for the Northern District of Ohio against Gem Specialty Health, Inc. The plaintiff alleges that the defendant’s use of similar branding constitutes trademark infringement and unfair competition.

GEMCORE claims that Gem Specialty Health’s use of “GEM SLEEP” and “GEM HEALTH” marks infringes upon its established family of trademarks. These trademarks are registered under various classes covering services such as retail pharmacy services, wellness consulting, and medical product distribution. GEMCORE has invested significantly in building goodwill associated with these marks since at least 2019. According to the complaint, Gem Specialty Health began using the infringing marks long after GEMCORE had already secured federal registration for its trademarks.

The lawsuit details how Gem Specialty Health’s actions have led to confusion among consumers regarding the origin and affiliation of their products and services. GEMCORE asserts that this confusion has caused actual damage to its business reputation and market position. The plaintiff also accuses the defendant of trading on its established goodwill without authorization or license.

In seeking relief from the court, GEMCORE requests a permanent injunction to prevent further use of the infringing marks by Gem Specialty Health. Additionally, they seek monetary damages for losses incurred due to the alleged infringement and unjust enrichment by the defendant. Enhanced damages are also sought due to what GEMCORE describes as intentional and willful misconduct by Gem Specialty Health.
