The Garden of Drip, LLC has filed a lawsuit against two former associates, alleging theft of sensitive patient information. The complaint was lodged in the United States District Court for the Southern District of Ohio on January 28, 2026, naming Lynsie Seta and Lindsay Shepherd as defendants.
The case centers around accusations that Seta, a former member of The Garden of Drip, and Shepherd, a former employee, unlawfully accessed and misappropriated confidential and proprietary information belonging to the wellness clinic. This includes protected health information (PHI) of over 1,200 patients, which is claimed to be in violation of the Health Insurance Portability and Accountability Act (HIPAA). According to the filing, Seta was removed from her position on December 10, 2025, due to misconduct under the company’s operating agreement. Shortly after her removal, it is alleged that she accessed and downloaded sensitive patient data without authorization. Similarly, Shepherd resigned on December 15, 2025, and is accused of similar acts following her departure. Both individuals are said to have set up a competing business shortly thereafter.
The Garden of Drip claims that despite repeated requests for the return of this data, both Seta and Shepherd have retained possession of these records. The plaintiff argues that their actions constitute not only a breach of confidentiality agreements but also violations under several legal statutes including the Defend Trade Secrets Act (DTSA) and the Computer Fraud and Abuse Act (CFAA). The lawsuit seeks injunctive relief to prevent further use or disclosure of the stolen information and demands its immediate return.
In addition to seeking damages for what they describe as irreparable harm caused by this alleged data theft, The Garden of Drip is asking for compensatory damages along with punitive measures against both defendants. They also request attorney fees be covered as part of any judgment awarded by the court.
